Terms of Service

Effective date: 6 November 2026.

Part A applies to all our services, Part B additionally to Punktfunk.

Part A – General terms

A1. Scope and provider

These Terms of Service ("Terms") govern your use of the services we operate under unom.io: the websites unom.io, punktfunk.unom.io and docs.punktfunk.unom.io, the code hosting platform git.unom.io, the unom account (account.unom.io), unom translate (translate.unom.io) and unom improve (improve.unom.io) (together, the "Services"). For Punktfunk – the website, the documentation and the software – Part B applies in addition; where the two parts conflict, Part B prevails for Punktfunk.

The Services are provided by Enrico Bühler, trading as unom, Schroffenstraße 44, 78628 Rottweil, Germany ("we", "us"). You can reach us at enrico.buehler@unom.io.

By using the Services, you agree to these Terms. When you sign in with the unom account, we point you to these Terms; before your first suggestion in unom translate, you expressly confirm the licence of your contributions and that your name will be shown. If you do not agree, please do not use the Services.

Software and other content in our repositories is governed by its open-source licence; these Terms do not limit the rights it grants. Third-party services you use together with ours – such as GitHub or Discord for signing in, our Discord server or the app stores – are governed by their own terms. The rules in Section A5 also apply on our Discord server.

A2. Free of charge, no guarantee of availability

The Services are free of charge. We do not guarantee that they are available, error-free or maintained, and we may change, suspend or discontinue them at any time. There is no entitlement to an account or to the continued provision of any Service. If we intend to shut down the unom account, unom translate or unom improve for good, we will announce this, where possible, at least four weeks in advance.

A3. The unom account

(1) The unom account is how you sign in to our applications. You create it by signing in one of the offered ways: with GitHub, Discord, git.unom.io or, where we offer it, a code sent by email.

(2) You may create a unom account only if you are at least 16 years old. The account is personal and cannot be transferred.

(3) Keep access to your sign-in methods secure, for example your GitHub or Discord account or your email mailbox. If you notice that someone else is using your account, end your sessions at account.unom.io and write to us.

(4) Your name and avatar are shown in our applications, for example to signed-in users next to your suggestions in unom translate. If you sign in with GitHub, Discord or git.unom.io, we take them from there; if you create the account with an email code, you choose your name yourself. Do not use a name or image that infringes the rights of others or is not permitted under Section A5.

(5) You can delete your account at any time at account.unom.io.

A4. Contributions

(1) Contributions are content you submit through our Services, in particular translation suggestions and comments in unom translate, posts and comments in unom improve, bug reports in our Discord forum, and issues, comments and code on git.unom.io.

(2) Only submit contributions to which you hold the necessary rights. In particular, do not copy text or code from sources whose licence is incompatible with the project's.

(3) You license translations and other contributions intended for a project's repository under that project's licence. For Punktfunk, this is the MIT License or the Apache License, Version 2.0, at the recipient's option, without any additional terms, as set out in the file CONTRIBUTING.md in the repository git.unom.io/unom/punktfunk. You keep your copyright.

(4) For bug reports, comments and other contributions that are not taken into a repository, you grant us a free, non-exclusive right, unlimited in space and time, to store them, to publish them – in particular in unom improve, on our public issue tracker and our Discord server –, to shorten, translate and format them, and to keep them as part of the project's history. Your right to have a published report removed (see the Privacy Policy) remains unaffected.

(5) When we accept a translation, we name you by your display name in the public description of the pull request on git.unom.io. If you do not want to be named there, write to us and we will remove your name.

(6) There is no entitlement to have a contribution accepted or published. You receive no payment for contributions.

(7) Published contributions are visible to everyone and may be indexed by search engines. Do not include confidential or personal data, including about other people. Please report security vulnerabilities privately to security@punktfunk.com.

A5. Rules for content and conduct

When using the Services, you must not in particular

  • post unlawful content or infringe the rights of others, such as copyright, trademark or personality rights;
  • insult, threaten or harass others, or incite hatred or violence;
  • submit advertising, spam or automatically generated contributions in bulk;
  • deliberately suggest wrong or misleading translations;
  • distribute malware, circumvent security measures or put excessive load on the Services through automated requests;
  • impersonate another person or publish other people's personal data without their consent.

A6. Moderation

(1) A reviewer checks translation suggestions before they are accepted. We publish your first post in unom improve only after we have seen it. We do not check content without a reason.

(2) If content is unlawful or breaches these Terms, we may reject, edit (for example to remove private details), hide or delete it. In the case of serious or repeated breaches, we may block individual features – for example exclude you from unom translate or unom improve –, block your account or terminate it (Section A8). We choose the mildest measure that is sufficient and take into account the legitimate interests of everyone involved, in particular freedom of expression.

(3) The operator makes these decisions personally. Only our protections against abuse work automatically – Turnstile on the contact form, the puzzle before email codes, rate limits and Anubis in front of git.unom.io. They turn requests away, but do not remove published content.

(4) If we restrict content or your account under paragraph 2, we tell you so and give our reasons, provided we have your contact details. You can contest the decision by email to enrico.buehler@unom.io, and we will review it again. You can also go to court at any time. A reviewer not accepting a suggestion for linguistic or technical reasons is not a restriction in this sense.

A7. Reporting unlawful content, point of contact

(1) If you believe content on our Services is unlawful, please report it by email to enrico.buehler@unom.io. The notice should contain:

  • an explanation of why the content is unlawful;
  • the exact address (URL) of the content;
  • your name and email address, except for notices concerning the offences referred to in Art. 16(2)(c) DSA;
  • a statement that you believe in good faith that the information in your notice is accurate and complete.

(2) We confirm receipt, review the notice promptly, diligently and objectively, and tell you our decision.

(3) The same address is our single point of contact for authorities, the European Commission and users under Art. 11 and 12 DSA. You can write to us in German or English.

A8. Termination, suspension and deletion

(1) You can stop using the Services at any time and delete your unom account at account.unom.io.

(2) We may terminate the agreement for your unom account with two weeks' notice. For good cause, in particular for serious breaches of these Terms or breaches repeated after a warning, we may suspend or delete the account without notice. Before we suspend or delete an account, we tell you why and give you the opportunity to respond, provided we have your contact details. We skip this only where the matter is urgent or hearing you first would defeat the purpose, for example with automated accounts or ongoing harm.

(3) On deletion, we remove your account data as described in the Privacy Policy. Contributions taken into a repository remain there under the project's licence; that licence is irrevocable. The rights under Section A4(4) continue unless you ask for removal.

A9. Warranty and liability

To the extent permitted by law, the Services are provided "as is" and "as available", without any warranty of any kind, whether express or implied, including but not limited to fitness for a particular purpose, uninterrupted or error-free operation, or the correction of defects. Mandatory statutory rights – in particular consumer rights that cannot be excluded – remain unaffected.

Because the Services are provided free of charge, we are liable only for intent and gross negligence.

Irrespective of the above, we are liable without limitation for damage arising from injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and in cases of fraudulently concealed defects.

By way of exception to the second paragraph, where we breach an essential contractual obligation – one whose fulfilment makes the proper performance of the agreement possible in the first place and on whose observance you may regularly rely – we are also liable for simple negligence, but limited to the foreseeable damage typical for this type of agreement. Any further liability is excluded.

A10. Changes to these Terms

We may change these Terms, for example when the Services or the legal situation change. The current version is always published on this page with its effective date. We announce changes at least two weeks before they take effect, when you sign in or by email. The new version applies to you only once you accept it, for example at your next sign-in. If you do not accept it, the previous version continues to apply to you; we may then terminate the agreement with the notice period in Section A8(2). You can delete your unom account at any time.

A11. Final provisions

These Terms and your use of the Services are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. To the extent legally permissible, the place of jurisdiction for disputes with merchants, legal entities under public law, or special funds under public law is Rottweil, Germany.

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG).

These Terms are provided in German and English. In the event of discrepancies between the versions, the German version prevails; the English version is for information only.

Part B – Punktfunk

This part governs your use of the Punktfunk website at punktfunk.unom.io, the Punktfunk documentation, and the Punktfunk software — the host application and the native client applications (together, the "Software"). The Software and this website are provided by Enrico Bühler, trading as unom, Schroffenstraße 44, 78628 Rottweil, Germany ("we", "us"). You can reach us at enrico.buehler@unom.io.

By downloading, installing, or using the Software, or by using this website, you agree to these Terms. If you do not agree, please do not use the Software or the website.

B1. What Punktfunk is

Punktfunk is self-hosted streaming software. You install a host on your own computer and a client on your own devices; the stream runs directly between your devices, over your own network or the internet. We provide the Software and this website — we do not operate a streaming service on your behalf, and we never receive, relay, or store the audio, video, or input that you stream. By default, the host and the Linux client ask git.unom.io for updates; the Privacy Policy explains what this transmits and how to turn the check off.

B2. Free of charge, no guarantee of availability

The source code and the downloads on this website are free of charge; the App Store and Google Play versions are sold for a fee. We do not guarantee that the Software, the downloads, the documentation, or the website are available, error-free, or maintained, and we may change, suspend, or discontinue any of them at any time without notice. There is no entitlement to updates or to continued provision. For the paid versions from the App Store and Google Play, statutory rights for digital products remain unaffected, in particular the right to updates needed to keep them in conformity with the contract (Section 327f of the German Civil Code, BGB).

B3. Licensing of the Software

Punktfunk's source code is open source and is dual-licensed under the MIT License or the Apache License, Version 2.0, at your option, as stated in its repository (see LICENSE-MIT and LICENSE-APACHE) at git.unom.io/unom/punktfunk. Your use, modification, and redistribution of the source code are governed by whichever of those licenses you choose. Pre-built binaries offered here are provided for convenience under the same terms, except for bundled third-party components (for example SDL, Opus, and openh264), which remain subject to their own licenses.

The names "Punktfunk" and "unom", the logos, and the design of this website are not covered by those open-source licenses and remain our property. Third-party names and trademarks are the property of their respective owners.

B4. Beta and pre-release software

Some builds are beta or pre-release versions — for example via Apple TestFlight, Google Play testing tracks, or pre-release downloads. These may be unstable, may change or be withdrawn, and may not work as described. You use them at your own risk; the liability provisions in Section B8 remain unaffected.

B5. Your responsibilities

You are responsible for how you use the Software. In particular, you agree to:

  • comply with all laws that apply to you;
  • only capture and stream content you are entitled to capture and stream;
  • comply with the terms of the third-party platforms and software you use it with (for example Valve/Steam, Apple, Google, NVIDIA, and the publishers of the games you play);
  • secure your own hosts, devices, networks, pairing PINs, and device trust; and
  • not use the Software to infringe the rights of others, to access systems you are not authorised to access, or for any unlawful purpose.

B6. Third-party services and components

Punktfunk interoperates with third-party platforms and protocols — including Valve's Steam, NVIDIA's GameStream protocol (and the independent third-party Moonlight and Artemis clients), Apple, and Google — and includes open-source components licensed by their respective authors. We are not affiliated with, endorsed by, or sponsored by these parties, and their trademarks belong to them. Your use of any third-party service or content remains subject to that third party's own terms.

B7. Disclaimer of warranties

To the extent permitted by law, the Software and the website are provided "as is" and "as available", without any warranty of any kind, whether express or implied, including but not limited to fitness for a particular purpose, uninterrupted or error-free operation, or the correction of defects. Mandatory statutory rights — in particular consumer rights that cannot be excluded — remain unaffected.

B8. Limitation of liability

Where we provide the Software free of charge, we are liable only for intent and gross negligence, including with respect to the freedom of the Software from defects of quality or title. For the paid versions from the App Store and Google Play, we are liable without limitation for intent and gross negligence, and for simple negligence only under the third paragraph; statutory warranty rights remain unaffected.

Irrespective of the above, we are liable without limitation for damage arising from injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and in cases of fraudulently concealed defects.

By way of exception to the first paragraph, where we breach an essential contractual obligation — one whose fulfilment makes the proper performance of the agreement possible in the first place and on whose observance you may regularly rely — we are also liable for simple negligence, but limited to the foreseeable damage typical for this type of agreement. Any further liability is excluded.

B9. Links to external sites

This website and the documentation contain links to external websites operated by third parties, over whose content we have no control and for which we accept no responsibility. The respective provider or operator of the linked pages is always responsible for their content.

B10. Data protection

Information on how we handle personal data is set out in our Privacy Policy and our Imprint.

B11. Changes to these Terms

We may amend these Terms where necessary, for example to reflect changes to the Software or to the legal situation. The current version is always published on this page with its effective date, and we will announce material changes in an appropriate manner (for example on this page or in the application). If you do not agree with a change, please stop using the Software and the website; your rights under the open-source licenses for the source code remain unaffected.

B12. Final provisions

These Terms and your use of the Software are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
